Objective – To compare the probiotic strains and quantities of colony forming units (CFU) in different types and brands of fermented dairy products. Methods – Fifteen fermented dairy products were selected in major supermarkets in the city of Araçatuba/SP. Their labels were evaluated according to the colony forming unit (CFU) and the type of probiotic culture used, in order to verify if they are in accordance or not with the legislation and have functional claim. The manufactures of the products that lacked the information on their packaging and labeling, were contacted via email or telephone for the necessary information. Results – It was observed that 66,7% of the analyzed products have functional properties, as they have the minimal CFU and type of probiotic culture recommended by ANVISA. It was found that 20% of the products are not produced based on the recommendations. Conclusion – Some probiotic products are not in accordance with the legislation’s recommendations, what makes it very important reading the label and choosing the right productwith functional claim.
